New York Labor Laws (Sections 240 and 241-6): Scaffold Laws

The New York State legislature has enacted a set of laws that protect construction workers who face elevation-related risk.
- Unsafe scaffolding: When scaffolding is poorly constructed, accidents are bound to happen. New York Scaffold Law (Section 240) puts responsibility for scaffold safety on the owners of the property, general contractors, and those responsible for erecting the scaffold. Failure to follow assembly instructions, failure to secure guardrails, failure to provide support systems for workers, and other negligence can lead to serious scaffolding accidents. These dangerous conditions can result in the scaffold collapsing, or workers falling.
- Dangerous construction site conditions: Construction sites are by nature dangerous. Under New York's labor laws (Section 241-6), employers have a duty to provide reasonable and adequate protection and safety to workers at the site. Failure to provide adequate safety lines, hard hats, or other equipment necessary to keep workers safe violates these laws and puts workers at risk for serious injuries. Likewise, failure to provide adequate training in operating heavy equipment such as cranes or forklifts can cause accidents which result in lifelong injuries.
